Deferred Disposition

Under CCP Article 45051, For Traffic Violations

Restrictions

You cannot request deferred if charged with the following:

  • A violation that occurred in a Construction Zone with Workers Present
  • Or a Commercial Drivers License Holders - Deferred Not Available

If defendant is under 25 years of age at the time of the traffic offense, as a condition they must complete a driving safety course.

Texas Residence

  • A copy of your driver's license
  • A copy of your personal insurance card
  • A defendant must enter a plea of no contest or guilty to request Deferred Disposition
  • A Driver's Safety Course will be ordered if under the age of 25 at the time of the offense
  • A Driving Test with the Department of Public Safety will be ordered if you are under the age of 18 and have a provisional drivers license
  • Return the completed deferred application that is posted below this notice either in person or by mail. If you choose to mail, please send a self addressed stamped envelope (call Court for amount owed)
  • A Driver's Safety Course will be required if speed is greater than 24 mph over the speed limit.

Out of State Residence

  • All rules apply as the Texas Residence rules.
